Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website instantcash-titleloans.com and any application, account, or product offered by Instant Cash Title Loans Inc, a Mississippi corporation with its principal office at 805 City Ave S, Ripley, MS 38663-2906 (DUNS 117148689). By using this site or applying for a loan, you agree to these Terms.

READ THIS FIRST. Loans are a serious financial commitment. Borrow only what you can afford to repay on the agreed schedule. Your vehicle is collateral; missed payments can result in repossession. If you have any doubt, take 24 hours and read everything before signing.

01 Eligibility

To apply you must be at least 18 years old (or the age of majority in your state), a U.S. citizen or permanent resident, hold a valid government-issued photo ID, possess a vehicle title with sufficient equity, hold current Mississippi vehicle insurance, and have verifiable, lawful income sufficient to cover loan payments after ordinary living expenses.

02 Loan products offered

We offer fixed-rate, fixed-term consumer installment loans secured by a lien on the borrower's vehicle title. Loan amounts range from $500 to $10,000, terms from 6 to 36 months, and APR is fixed at signing between 17.99% and 35.99%. We do not offer short-term payday products, balloon-payment products, or open-end credit.

03 Application and underwriting

The online application initiates a soft credit inquiry (no impact on your credit score). If we extend an offer and you accept it, a hard inquiry is performed. We verify identity, employment, income, and vehicle equity. We perform an ability-to-repay analysis as required by federal Reg. Z. We may decline applications without disclosing the specific underwriting model used.

04 Truth-in-Lending disclosures

Before signing, you will receive a Truth-in-Lending disclosure stating: amount financed, finance charge, APR, total of payments, payment schedule, security interest, late charges, prepayment terms, and reference to the contract for non-payment, default, and prepayment rebates. Sign nothing until every figure on that disclosure is clear to you.

05 Right to cancel

You have the right to cancel this loan within three (3) business days of signing without penalty by returning the full principal in cash, certified check, or money order to our Ripley office during business hours. Once cancelled, the lien on your vehicle title is released within five business days at no cost to you.

06 Repayment

Payments are equal monthly installments due on the same calendar day each month. Default repayment method is ACH from the bank account you provide; we also accept payments by debit card, money order, or in-office cash. There is a 10-day grace period before any late fee applies. Late fees are a flat $15 per occurrence; we do not impose tiered or escalating late fees.

07 Prepayment

You may prepay any portion or the entire loan at any time without penalty. Interest accrues daily on the outstanding principal, so any extra payment immediately reduces the interest you'll owe.

08 Default

You are in default if a scheduled payment is more than 30 days past due, you misrepresent material information on the application, the vehicle securing the loan is sold without our consent, the vehicle is uninsured, or insurance/registration is allowed to lapse. Upon default we will attempt cure by phone, mail, and email. We follow all collection-practice rules under federal FDCPA and the Mississippi Consumer Loan Act.

09 Repossession

Repossession is a last resort. Before any repossession we will: (a) provide written notice of default and cure period, (b) attempt to negotiate a workout or hardship plan, (c) wait the period required by Mississippi law. After repossession, you have a statutory redemption period to recover the vehicle by paying the past-due amount plus reasonable repossession costs. Surplus from any sale is returned to you; any deficiency remains your responsibility.

10 Insurance requirement

You must maintain comprehensive and collision insurance on the vehicle for the life of the loan, with Instant Cash Title Loans Inc named as loss payee. If your insurance lapses, we may purchase force-placed insurance and add the premium to the loan balance. Force-placed insurance is typically more expensive than insurance you obtain on your own.

11 Credit reporting

We furnish account information (open/close, balance, payment status) to one of the three nationwide consumer reporting agencies on a monthly cycle. Late or missed payments may negatively affect your credit score. Disputes about reported information should be sent in writing to: FCRA Disputes, 805 City Ave S, Ripley, MS 38663-2906.

12 Electronic signatures and records

You consent to receive disclosures, agreements, statements, and notices in electronic form and to sign loan documents electronically under E-SIGN and UETA. You may withdraw consent for electronic delivery at any time by emailing info@instantcash-titleloans.com; paper copies will then be mailed.

13 Privacy

How we handle your personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

14 Acceptable use of the website

You agree not to: (a) use the site to apply for a loan with intent to defraud; (b) attempt to access accounts, systems, or data not your own; (c) introduce malware or attempt to disrupt the site; (d) use scraping, automated data collection, or robotic means to retrieve content; (e) impersonate any person or entity. We may suspend or terminate access for violations.

15 Intellectual property

All site content — text, graphics, logos, software, page layout — is owned by Instant Cash Title Loans Inc or its licensors and protected by U.S. copyright and trademark law. You may not reproduce, modify, distribute, or create derivative works without our prior written consent, except for personal, non-commercial use of your own account information.

16 Disclaimers

The site is provided "as is" and "as available." We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, except those that cannot be disclaimed under applicable law. We do not warrant uninterrupted or error-free operation.

17 Limitation of liability

To the maximum extent permitted by law, Instant Cash Title Loans Inc, its officers, employees, and contractors are not liable for indirect, incidental, special, consequential, or punitive damages arising out of your use of the site or the loan, even if we have been advised of the possibility of such damages. Total aggregate liability for any claim arising out of these Terms shall not exceed the amount you have paid us in the 12 months preceding the claim. Nothing in this Section limits your rights under FCRA, ECOA, TILA, or other federal consumer-protection statutes.

18 Governing law and venue

These Terms are governed by the laws of the State of Mississippi and applicable federal law. Any action arising out of or relating to these Terms or the loan shall be brought exclusively in the state or federal courts seated in Tippah County, Mississippi, except as provided in the arbitration section of your loan agreement.

19 Equal Credit Opportunity

The federal Equal Credit Opportunity Act (ECOA) prohibits creditors from discriminating against applicants on the basis of race, color, religion, national origin, sex, marital status, age (provided the applicant has the capacity to contract), or because all or part of the applicant's income is from a public-assistance program. We comply with ECOA. The federal agency that administers our compliance with ECOA is the Consumer Financial Protection Bureau, 1700 G Street NW, Washington, DC 20552.
